1. About these Terms

These Terms of Service ("Terms") are a binding agreement between you and Rushstack and govern your use of the Rushstack auction marketplace at rushstack.us and the live sales chat at chat.rushstack.us (together, the "Service"). By creating an account, bidding, buying, or selling, you accept these Terms. If you do not agree, do not use the Service. You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract.

2. Your account

  • You are responsible for keeping your login credentials secure and for all activity that happens under your account.
  • You must provide accurate information and keep it up to date. Sellers may be asked to verify their identity or business before payouts are released.
  • One person or business per account. Creating accounts to manipulate auctions (for example, to bid on your own listings) is prohibited.

3. Bidding & how auctions work

Every bid you place is a binding offer to buy the item at that price. Bids cannot be retracted except in the limited circumstances we allow (such as an obvious typo reported immediately). When an auction ends, the highest valid bid wins.

  • Regular (Thunder) Bid. Places the exact amount you enter as your current bid.
  • Maximum (Proxy) Bid. You set the most you are willing to pay, and the system bids on your behalf in set increments only as much as needed to keep you in the lead, up to your maximum. Other bidders never see your maximum.
  • Bid increments are tiered by price (for example, $1 below $100, rising to $25 at $1,000+) and are applied automatically.
  • Outbid notifications. If someone exceeds your maximum, we notify you by email and, where enabled, by web-push so you can decide whether to bid again.
  • We may extend an auction's end time slightly if a bid arrives in the final moments, to keep bidding fair.

4. Fees & payment

  • Buyers pay 0% commission. You pay your winning bid plus any applicable taxes and shipping shown at checkout.
  • Sellers pay a 5% commission on the final sale price, deducted from the proceeds before payout.
  • Winning buyers must complete payment promptly after an auction closes. Failure to pay may result in cancellation of the sale, loss of bidding privileges, and account suspension.
  • Payments are processed by third-party payment providers; Rushstack does not store full card details.

5. Selling on Rushstack

  • You may only list items you legally own and are entitled to sell. Listings must be accurate, complete, and not misleading, including the condition, authenticity, and any defects.
  • Prohibited items include anything illegal, counterfeit, stolen, recalled, or otherwise restricted by law.
  • You must honour the sale to the winning bidder at the final price and ship within the timeframe stated in your listing.
  • You grant Rushstack a licence to display the text and images you upload for the purpose of operating and promoting the marketplace.

6. Authenticity & condition

Sellers are responsible for the accuracy of their descriptions. Rushstack is a venue that connects buyers and sellers; unless we expressly state otherwise for a given lot, we do not independently authenticate or appraise items. Buyers should review photos and descriptions and ask questions before bidding.

7. Prohibited conduct

You agree not to manipulate bids or prices (including shill bidding), interfere with the Service, scrape or misuse data, post unlawful or infringing content, or attempt to transact off-platform to avoid fees. We may cancel bids, remove listings, and suspend or terminate accounts that violate these Terms.

8. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Rushstack is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to a transaction is limited to the commission we earned on that transaction.

9. Governing law & changes

These Terms are governed by the laws of the United States and the state in which Rushstack is established, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be posted here with a new "Last Updated" date and, where appropriate, communicated by email. Continued use after changes take effect means you accept the updated Terms.
